10. Governing Law and Disputes
These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the United Arab Emirates, applied as if executed and performed entirely within the Emirate of Sharjah.
Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the courts of the Emirate of Sharjah, and you irrevocably submit to the jurisdiction of such courts. However, for disputes involving commercial partners or claims exceeding USD 50,000, either party may elect to resolve the dispute through binding arbitration administered by the Sharjah International Commercial Arbitration Centre (Tahkeem) or the Abu Dhabi Commercial Conciliation and Arbitration Centre (ADCCAC) , in accordance with their rules then in effect.
If you are located outside the UAE, nothing in this Section prevents you from filing a complaint with your local consumer protection authority, but any binding legal proceeding shall be held exclusively in Sharjah, UAE, to the maximum extent permitted by law.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
If you are a consumer located in the European Union or the United Kingdom, nothing in this Section deprives you of the mandatory consumer protection laws of your country of residence. In such case, you may also bring a claim in the courts of your country of residence, and these Terms shall be interpreted to give you the benefit of those mandatory laws.
